Filing for a Restraining Order

Anyone who files for a temporary restraining order will have his or her application reviewed by a judge. The judge will determine whether to sign the temporary order. Within several weeks, a hearing will be held to determine if the temporary order should be made permanent. In order to make the order permanent, the petitioner needs to prove that he or she was the victim of domestic violence. This can include many things including any of the following:

  • That ongoing, daily harassment has taken place
  • That he or she has experienced an act of violence from the accused
  • The he or she has experienced the threat of violence from the accused

If the order prevents the accused from having any contact with you, then he or she will not be able return home or visit you at work. If the couple has children, this order can be the basis of limiting contact with them.
